BEWARE! Illinois Firefighter Ineligible For Non-Duty Disability Pension

The First District Appellate court recently held that a firefighter who transfers from one fire department to another must requalify for a non duty disability pension by serving another seven years of creditable service with the new department, even though the firefighter had qualified for the non-duty disability pension with the prior department.

In short, the firefighter’s years of creditable service cannot be transferred to the new department and the firefighter is divested of the non duty pension he would have earned with the prior department. See Wessel v. Wilmette Firefighters Pension Fund 2024 IL App (1st) 230565.
